Onderzoek: 16% van de zakenbankiers begaat een misdaad als zij daarmee weg kunnen komen; LIBORschandaal II.

'Wellicht is nog het meest verrassende aspect aan het LIBOR schandaal hoe vertrouwd het allemaal is....' die reactie gaf columnist Eduardo Porter in zijn bijdrage vorige week aan The New York Times.

Het citaat in de kop van dit artikel komt uit een (ook) vorige week gepubliceerd onderzoek door Law Firm LABATON SUCHAROW: "Particularly troubling, 16 percent of respondents reported that they would commit a crime—insider trading—if they could get away with it."

& Dat de zakenbankiers (opnieuw) weg kunnen komen, deze keer uit het LIBOR schandaal, die indruk kun je krijgen uit een bericht dat vandaag bekend wordt gemaakt: Deutsche Bank heeft clementiestatus in Libor-schandaal. Als Overheden clement zijn tegenover personen die opzichtig in de fout gaan, dan is het inderdaad de vraag of er verbetering in hun gedrag plaatsvindt* .... Het is te hopen dat DB net zo clement is t.o.v. hun klanten. :-o

Terug naar het onderzoek van LABATON SUCHAROW want die resultaten zijn zeker interessant: "Labaton Sucharow LLP today announced the results of its survey of 500 financial services professionals across the United States and United Kingdom."

Het LS persbericht heeft als titel: Financial Services Professionals Feel Unethical Behavior May Be a Necessary Evil and Have Knowledge of Workplace Misconduct, According to Labaton Sucharow Survey.

Synopsis van de uitkomsten van het onderzoek dat in juni is uitgevoerd in The City en in Wall Street:

  • "24 percent of respondents reported a belief that financial services professionals may need to engage in unethical or illegal conduct in order to be successful, while
  • 26 percent of respondents indicated that they had observed or had firsthand knowledge of wrongdoing in the workplace.
  • particularly troubling, 16 percent of respondents reported that they would commit a crime—insider trading—if they could get away with it.
  • 39 percent of respondents reported that their competitors are likely to have engaged in illegal or unethical activity in order to be successful;
  • 30 percent of respondents reported their compensation or bonus plan created pressure to compromise ethical standards or violate the law, while
  • 23 percent of respondents reported other pressures that may lead to unethical or illegal conduct; and
  • 30 percent of respondents feel that the SEC/SFO effectively deters, investigates and prosecutes misconduct—despite the new leadership, record enforcement actions and new reforms; 29 percent of respondents feel the same way about FINRA/FSA."

Als je beseft dat het onderzoek nog zéér recent is uitgevoerd en dat wij, gewone mensen, met een financieel-economische crisis te maken hebben, dan vraag je jezelf inderdaad af 'hoe kan het toch zijn dat voor een bepaalde sector alles nog steeds zo vertrouwd genoeg lijkt voor business as usual'... Natuurlijk kun je ook stellen dat '84% géén misdaad zal begaan', gezien het maatschappelijk belang van de sector is ieder % er één teveel, toch?

Commentaar van LABATON SUCHAROW op de onderzoeksresultaten:

"While most professionals in the financial services industry act ethically and within the bounds of the law, a significant percentage is still ‘at risk.’

While financial regulators and law enforcement authorities across the globe have new leadership, new investor protection initiatives and record enforcement activity, professionals in the financial services industry do not yet believe that these watchdogs are effectively protecting the public.

The best way to avoid corporate scandals is to establish and nurture a culture of integrity in the workplace. Too often, scandals result from a long chain of mistakes, where one breakdown in judgment cascades to another breakdown, and then another. In time, isolated and seemingly random unethical or illegal choices snowball into front page scandals.

We’re On Notice: 30% of financial services professionals feel that their compensation or bonus plan has created pressure to compromise ethical standards or violate the law."  Cultuur én arbeidsvoorwaarden blijken een 'goede basis' te zijn voor onethisch handelen; die constatering is er niet voor het eerst.

In alle ellende is er nog iets opmerkelijks "Gender Matters. In the US, there was a 10-point spread with respect to gender views on retaliation, with 22% of women in the financial services industry believing they would be retaliated against if they reported misconduct, 10% more than their male counterparts." Als vrouwelijke medewerkers 'uit de school klappen' (over onethisch gedrag bijv.) dan krijgen zij sneller straf dan hun mannenlijke collegae.... Ook 'a cultural issue' van deze sector dus. :-o

REUTERS heeft n.a.v. dit onderzoek nog een leuk citaat: "If the ancient Greek philosopher Diogenes were to go out with his lantern in search of an honest man today, a survey of Wall Street executives on workplace conduct suggests he might have to look elsewhere." ;-)
